Short Answer Questions
Question 1 (marked out of 5) – arrest.
Describe the arrest, using appropriate Queensland legislation to support your answer. Do you think the arrest was lawful or not. Explain your reasoning.
Question 2 (marked out of 5) – use of force.
You and I have gone down to the local corner shop to buy a Slushie. Suddenly, police cars swoop into the area and two police officers enter the shop shouting “Drop your weapons.” I say that I am unarmed but I have a black belt in origami so watch out. One of the officers immediately reacts to my response and tasers me.
Define the type of force used, with supporting evidence and explain your response. Was it reasonable under the circumstances? Why/why not?
Question 3 (marked out of 5) – discretion.
The use of discretion impacts a person’s pathway through the criminal justice system. Discuss either police direction, prosecutorial discretion or judicial discretion and explain both positive and negative impacts on a person’s pathway. Are there any other factors which can influence discretion?
Question 4 (marked out of 5) – jury trial.
Congratulations!! You have been asked to apply for a much-coveted Griffith University Research Assistant position in relation to a research project on criminal juries. You have been asked to find one peer review article in relation to criminal jury trials (either overseas or in Australia) and provide an annotated bibliography (WHAT???!!!). Don’t panic!!
