This assignment will consist of four essay questions that need approximately 250 words per question. There will be four scenarios and you must be able to cite cases and principles of law. And explain what crimes were committed.
1. Dwight Shrute was sick and tired of the constant workplace harassment instigated by his coworker, Jim Halpert. One day after work, Dwight followed Jim to the employee parking lot in the late evening. Dwight was armed with a kitchen knife, and snuck up behind Jim once he was sure there was no one else around. He plunged the knife into his back, somehow missing all major organs. If he had received immediate medical attention, Jim would have had a good chance of surviving. But, Jim, thinking that he was mortally wounded and not wanting to suffer, took out a pistol and shot himself in the head. He died immediately. Dwight is charged with Murder and Attempted Murder. What can he be convicted of? Please cite cases
2. June Osborne is a handmaid (forced servant) in Commander Waterford’s home, and Aunt Lydia is her boss. Tired of June’s constant rebelliousness (trying to escape, leading revolts, murdering other Commanders, etc.), Aunt Lydia informs June that her days are numbered, and she will kill her as soon as the Commander leaves for a business trip. For June to kill Lydia in self-defense, when must it occur? Explain your answer, citing cases.
3. Johnny Rose, a former billionaire, found himself bankrupt and living in a motel after losing everything. Seeking to make a fresh start for himself and provisions for his wife, Moira, he took out a life insurance policy, naming his wife as beneficiary. He then faked his own death in a staged drowning incident, and secretly traveled to England under a false passport and a new identity. He was later discovered in England and his plot revealed before his wife, who had no idea what he had done, had applied for the insurance benefits. Insurance fraud is defined as making a false statement on an insurance claim, in order to receive a benefit. Can he be successfully prosecuted for attempted insurance fraud? Please cite cases.
4. Carrie Mathison is the most talented young field agent the CIA has seen, at least since her mentor, Saul, was a young man. She also suffers from Bipolar Disorder. As long as she takes her bipolar medication, she can function normally. When she does not take her medication, she becomes manic, suffers hallucinations, and acts erratically. During one of these manic episodes, she shoots her gun at a person she believes to be Nicholas Brody, whom she believes to be a terrorist about to attack the United States. In reality, she shot and killed Saul, who was bringing her a bowl of soup. She is charged with murder.Can she be convicted? What defenses should she raise?
